The Nigeria Civil Aviation Authority (NCAA) has clarified that the final decision regarding the case involving veteran fuji musician, Wasiu Ayinde Marshal, popularly known as K1 de Ultimate or KWAM1, rests with the Attorney General of the Federation and the Inspector General of Police.

This was made known by NCAA spokesperson Michael Achimugu in response to KWAM1’s public apology concerning a recent incident at the local wing of the Nnamdi Azikiwe International Airport in Abuja. The event, which occurred on Tuesday, August 5, 2025, involved a confrontation between the musician and officials of ValueJet Airline.

In a signed statement, KWAM1 described the confrontation as “unfortunate” and insisted that he never intended to disrupt airport operations or breach aviation regulations.

A video clip of the altercation circulated widely online, showing the artist appearing to block a plane from taking off. The footage sparked public outcry and led to swift sanctions. The Minister of Aviation and Aerospace Development, Festus Keyamo, along with the NCAA, imposed a six-month flight ban on the singer. The pilots involved were also suspended pending investigation.

The NCAA confirmed it had formally petitioned the Attorney General and the Police Chief, seeking an investigation and possible prosecution of the musician.

On Friday, KWAM1 released an apology video where he explained that the incident was not premeditated. He attributed part of the confusion to a health condition, revealing that he suffers from chronic dehydration and carries a water flask for medical reasons. He denied allegations that the flask contained alcohol and maintained that it only held water, filled at the lounge after he passed through security.

Responding to questions about the apology, the NCAA spokesman said he had not yet seen it and reiterated that the authority has no legal power to prosecute, stating, “We’ve handed the matter over to the Attorney General and the Inspector General of Police, who are better positioned to take the next steps.”

Aviation Minister Festus Keyamo also acknowledged seeing the apology on social media but emphasized that no formal decision had been made. “We only just saw it like everyone else. There hasn’t been any internal discussion yet,” he said in a brief message.

When contacted regarding the petition, the police spokesperson, Muyiwa Adejobi, said he would need to check official records and promised to respond. As of the time of this report, he had yet to do so, and follow-up calls remained unanswered.

Efforts to obtain comments from the Office of the Attorney General were also unsuccessful.

In his public statement, KWAM1 reaffirmed his loyalty to Nigeria, saying, “For over five decades, I have used my platform to promote Nigerian culture worldwide. I would never intentionally damage my reputation or that of my country.”

He further expressed regret for the situation and offered a heartfelt apology to the Presidency, the Ministry of Aviation, FAAN, NCAA, ValueJet, and his global fanbase.

The incident, captured in viral videos, showed KWAM1 dangerously close to a moving aircraft, with one clip displaying the plane’s wing nearly hitting him as he stood in its path.
